Kính thưa Quý vị,

Với mục tiêu bảo vệ quyền sở hữu đất đai, tài sản tôn giáo và quyền lợi hợp pháp của các gia đình nạn nhân, trước những hành vi chiếm đoạt bất hợp pháp, đàn áp, bạo hành và vi phạm nhân quyền nghiêm trọng của chế độ cộng sản tại Việt Nam, chúng tôi trân trọng gửi đến Quý vị MẪU ĐƠN THÔNG BÁO (COMMUNICATION) GỬI TÒA ÁN HÌNH SỰ QUỐC TẾ – ICC, gồm các bản Tiếng Việt, Tiếng Anh và Tiếng Pháp, để Quý vị tùy nghi sử dụng và hoàn thiện.

I. Mục tiêu của Mẫu Đơn

Mẫu đơn này được soạn thảo nhằm:

1.       Đòi công lý cho các nạn nhân của tội ác chống loài người và các hành vi vi phạm nhân quyền nghiêm trọng, bao gồm:

o   Bắt giữ, tra tấn, đối xử tàn ác, giam cầm tùy tiện;

o   Cưỡng bức đưa vào bệnh viện tâm thần;

o   Đàn áp các tín đồ, tu sĩ, giáo sĩ và nhà hoạt động nhân quyền;

o   Chiếm đoạt đất đai, nhà thờ, chùa chiền, thánh thất, trường học, bệnh viện và cơ sở xã hội do tôn giáo quản lý.

2.       Yêu cầu bồi thường thiệt hại về vật chất, tinh thần và tài sản mà các nạn nhân và gia đình đã chịu đựng.

3.       Đòi khôi phục quyền lợi hợp pháp, bao gồm đất đai, tài sản tôn giáo và các cơ sở giáo dục, y tế, tôn giáo bị tịch thu hoặc phá hủy.

II. Cơ sở pháp lý quốc tế

Các hành vi nêu trên có thể cấu thành tội ác chống loài người theo Điều 7 Quy chế Rome, bao gồm:

·         Bắt bớ hoặc tước đoạt tự do một cách tùy tiện;

·         Tra tấn, cưỡng bức;

·         Đàn áp dựa trên tôn giáo;

·         Các hành vi vô nhân đạo khác;

Ngoài ra, hành vi tấn công, phá hủy hoặc chiếm đoạt tài sản tôn giáo có thể cấu thành tội ác chiến tranh theo Điều 8 Quy chế Rome, nếu liên quan đến xung đột vũ trang, và đồng thời vi phạm nghiêm trọng các chuẩn mực nhân quyền quốc tế, bao gồm:

·         Công ước Quốc tế về các Quyền Dân sự và Chính trị (ICCPR)

·         Công ước Chống Tra tấn (CAT)

·         Công ước về Quyền của Các Tổ chức Tôn giáo

Những cơ sở pháp lý này tạo nền tảng vững chắc để ICC xem xét mở điều tra sơ bộ hoặc chính thức về các hành vi vi phạm nêu trên.

III. Lời kêu gọi hành động

Chúng tôi tha thiết đề nghị Quý vị:

1.       Xem xét, góp ý, chỉnh sửa và bổ sung mẫu đơn để đảm bảo giá trị pháp lý cao nhất.

2.       Điền chi tiết cụ thể về từng vụ việc, nạn nhân và bằng chứng, và gửi đơn đi càng sớm càng tốt.

3.       Đồng hành trong việc bảo vệ công lý, tự do tôn giáo, nhân quyền và toàn vẹn lãnh thổ của Việt Nam.

Hiện nay là thời điểm thuận lợi trên diễn đàn quốc tế, khi Tổng thống Donald Trump và Hạ viện Hoa Kỳ đã có những tuyên bố mạnh mẽ phản đối các hành vi chiếm đoạt tài sản, đàn áp và giết hại vô tội của chế độ cộng sản. Hành động khẩn trương sẽ gia tăng áp lực quốc tế và nâng cao khả năng đạt được công lý cho các nạn nhân và cộng đồng Việt Nam.

IV. Kết luận

Chúng tôi trân trọng kính mời Quý vị sử dụng mẫu đơn này, đồng hành với chúng tôi trong cuộc đấu tranh vì nhân quyền, tự do tôn giáo và toàn vẹn lãnh thổ, và hỗ trợ ICC trong việc xác minh, điều tra và truy cứu trách nhiệm những hành vi vi phạm pháp luật quốc tế.

PHẦN III – TÓM TẮT CÁC HÀNH VI BỊ CÁO BUỘC

Người nộp đơn xin trình bày thông tin liên quan đến các hành vi bị cáo buộc đã diễn ra trong thời gian dài, tác động đến tín đồ, giáo sĩ và các cộng đồng tôn giáo khác nhau tại Việt Nam, bao gồm nhưng không giới hạn:

1. Các cáo buộc liên quan đến đàn áp, tra tấn, đối xử tàn ác

·         Trấn áp, bắt giữ không xét xử minh bạch.

·         Tra tấn, ép cung, bức cung trong quá trình điều tra hoặc giam giữ.

·         Giam cầm, quản chế, tù đày trong điều kiện bị cáo buộc là vô nhân đạo.

·         Cưỡng bức đưa vào bệnh viện tâm thần mà không có căn cứ y khoa.

·         Theo dõi, sách nhiễu, đe dọa giáo sĩ, tu sĩ, tín đồ và người hoạt động bảo vệ nhân quyền, tự do tôn giáo, môi trường, chủ quyền quốc gia.

Các nhóm bị ảnh hưởng được báo cáo bao gồm:

·         Các Tổng Giám mục, Giám mục, Linh mục

·         Các Hòa Thượng, Thượng Tọa, Đại Đức, Tăng Ni

·         Mục sư, Truyền đạo Tin Lành

·         Chức sắc Phật giáo Hòa Hảo

·         Các tín đồ thuộc mọi tôn giáo

·         Các nhà hoạt động bảo vệ nhân quyền, môi trường, dân chủ

2. Các cáo buộc liên quan đến tước đoạt tài sản tôn giáo

·         Trưng thu, tịch thu hoặc chiếm dụng đất đai tôn giáo mà không có bồi thường thỏa đáng.

·         Thu hồi không minh bạch hoặc cưỡng chế các tài sản thuộc:

o   Nhà thờ

o   Chùa chiền

o   Thánh thất

o   Trường học do tôn giáo quản lý

o   Bệnh viện và cơ sở xã hội do tôn giáo sáng lập

·         Phá hoại các biểu tượng tôn giáo, bao gồm:

o   Thánh giá

o   Tượng thánh

o   Công trình thờ tự

o   Báo cáo về gài vật liệu nổ hoặc phá hoại tài sản tôn giáo

Dear Sir/Madam,

With the goal of protecting land, religious property, and the lawful rights of families of victims against acts of illegal appropriation, oppression, abuse, and serious human rights violations committed by the communist regime in Vietnam, we respectfully submit to you the MODEL COMMUNICATION TO THE INTERNATIONAL CRIMINAL COURT (ICC), available in Vietnamese, English, and French, for your use and adaptation as appropriate.

I. Purpose of the Communication

This model communication is intended to:

1.       Seek justice for victims of crimes against humanity and gross human rights violations, including:

o   Arbitrary arrest, detention, torture, and cruel treatment;

o   Forced commitment to psychiatric institutions;

o   Suppression of clergy, monks, religious leaders, followers, and human rights defenders;

o   Illegal seizure of land, churches, pagodas, temples, religious schools, hospitals, and other social facilities managed by religious organizations.

2.       Request compensation for material, psychological, and property damages suffered by victims and their families.

3.       Demand the restoration of lawful rights, including land, religious property, and educational, medical, and religious facilities that were confiscated or destroyed.

II. International Legal Basis

The acts described above may constitute crimes against humanity under Article 7 of the Rome Statute, including:

·         Arbitrary arrest or deprivation of liberty

·         Torture and coercion

·         Persecution based on religion

·         Other inhumane acts

In addition, attacks, destruction, or seizure of religious property may constitute war crimes under Article 8 of the Rome Statute, if occurring in the context of armed conflict, and simultaneously constitute serious violations of international human rights standards, including:

·         International Covenant on Civil and Political Rights (ICCPR)

·         Convention Against Torture (CAT)

·         Conventions protecting the rights of religious organizations

These legal foundations provide a strong basis for the ICC to consider opening a preliminary examination or formal investigation into the alleged acts.

III. Call to Action

We respectfully urge you to:

1.       Carefully review, provide feedback, amend, and supplement the model communication to ensure maximum legal effectiveness.

2.       Include specific details regarding individual cases, victims, and evidence, and submit the communication as soon as possible.

3.       Join in the effort to protect justice, religious freedom, human rights, and the territorial integrity of Vietnam.

The current moment represents a favorable international political and legal opportunity, as former President Donald Trump and the U.S. House of Representatives have issued strong statements condemning the communist regime’s acts of illegal seizure, oppression, and unlawful killings. Prompt action will increase international pressure and enhance the likelihood of justice for victims and the Vietnamese community.

Dans le but de protéger la propriété foncière, les biens religieux et les droits légitimes des familles de victimes contre les actes de confiscation illégale, d’oppression, d’abus et de violations graves des droits humains perpétrés par le régime communiste au Vietnam, nous avons l’honneur de vous soumettre le MODÈLE DE COMMUNICATION À LA COUR PÉNALE INTERNATIONALE (CPI), disponible en vietnamien, anglais et français, afin que vous puissiez l’utiliser et l’adapter selon vos besoins.

I. Objectif de la Communication

Cette communication modèle a pour but de :

1.       Demander justice pour les victimes de crimes contre l’humanité et violations graves des droits humains, notamment :

o   Arrestations arbitraires, détentions, tortures et traitements cruels ;

o   Internements forcés dans des établissements psychiatriques ;

o   Répression contre le clergé, les moines, les responsables religieux, les fidèles et les défenseurs des droits humains ;

o   Saisie illégale de terrains, églises, pagodes, temples, écoles religieuses, hôpitaux et autres structures sociales gérées par des organisations religieuses.

2.       Demander réparation et compensation pour les dommages matériels, psychologiques et aux biens subis par les victimes et leurs familles.

3.       Exiger la restitution des droits légitimes, y compris les terrains, biens religieux et établissements éducatifs, médicaux et religieux confisqués ou détruits.

II. Base juridique internationale

Les actes décrits ci-dessus peuvent constituer des crimes contre l’humanité en vertu de l’Article 7 du Statut de Rome, notamment :

·         Arrestation ou privation de liberté arbitraire

·         Torture et coercition

·         Persécution fondée sur la religion

·         Autres actes inhumains

De plus, les attaques, destructions ou saisies de biens religieux peuvent constituer des crimes de guerre en vertu de l’Article 8 du Statut de Rome, lorsqu’elles se produisent dans le contexte d’un conflit armé, tout en constituant des violations graves des normes internationales en matière de droits humains, notamment :

·         Pacte international relatif aux droits civils et politiques (PIDCP)

·         Convention contre la torture (CAT)

·         Conventions protégeant les droits des organisations religieuses

Ces bases juridiques offrent un fondement solide pour que la CPI envisage l’ouverture d’un examen préliminaire ou d’une enquête officielle sur les actes allégués.

III. Appel à l’action

Nous demandons respectueusement à chacun :

1.       De réviser attentivement, commenter, corriger et compléter cette communication afin d’assurer sa pleine efficacité juridique.
